Terms and Conditions of our Luxury Condos

 

1. Introduction

Welcome to our Sanctuary Spaces booking service offered through our website ("Service"). By opting in and using our Service, you agree to abide by the following terms and conditions ("Terms"). Please read these Terms carefully before making a booking.  By opting into Sanctuary Spaces booking service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions listed below. These Terms and Conditions are subject to change without notice,

2. Booking, Payment & Confirmation

​

2.1 When you make a booking through our website, you are required to provide a government-issued ID or Passport.

2.2 The payment for your booking will be processed securely through our chosen payment gateway. By confirming your booking, and upon receipt of your payment in full, you agree to the Terms listed in this agreement and as displayed on this website.

2.3 All payments are non-refundable and non-transferable, except as outlined in the cancellation policy below.

2.4 Full payment for your stay is required at the time of booking.

2.5 A reservation is considered provisional until the host confirms acceptance of the reservation. We confirm the reservation by email or platform messaging services.

2.6 Accommodation dates cannot be held or reserved until payment is received in full.

2.7 No cashback is permitted. By opting into the Sanctuary Spaces booking service, you acknowledge and agree that you will not be eligible for cashback or any form of refund after making the payment.

2.8 There are multiple payment options to choose from for your convenience. To avoid the 3.5% credit card service fee we accept payment as a cash option via Bank Transfer or Zelle. My account can be found under my phone number: 214-435-1820.

3. Cancellation Policy

​

3.1 You may cancel an accommodation at any time prior to check-in.

3.2 Cancellations must be done in writing (e.g., email/platform messaging services).

3.3 Full refunds on accommodations are permitted when you cancel within 48 hours after booking, provided the agreed-upon check-in date is more than 10 days following the cancellation notice.

3.4 If you cancel a reservation more than 48 hours after booking and cancellation notice is not less than 90 days prior to your agreed-upon check-in date, you will receive a 50 percent refund.

3.5 No refunds are permitted for cancellations within 90 days of the agreed-upon check-in date.

4. Changes to Bookings

​

4.1 Changes to booking dates or other details are subject to availability and our approval.

4.2 If you wish to change your booking dates, you must notify us at least 90 days before the original check-in date. Changes requested less than 90 days before the check-in date will not be accommodated.

5. Property Regulations & Damages

​

5.1 You are expected to comply with all property rules and regulations provided by the staff at the Kona Islander Inn. Failure to do so may result in additional charges or termination of your stay without a refund.

5.2 Any damages caused to the property or its contents during your stay will be your responsibility and may incur additional charges.

5.3 A damage deposit of $150 is required for each reservation and must be paid at the time your reservation is confirmed.

5.4 You are responsible for leaving the accommodation in the condition it was in when you arrived.

5.5 You and those in your party are responsible for your own acts and omissions, and you are also responsible for the acts and omissions of any individuals you invite to the accommodation.

5.6 We may deduct damage costs from your damage deposit for property damage caused during your stay.

6. Occupancy Term

​

6.1 Use of premises shall commence at 4:00 PM on the date of the scheduled check-in and will immediately terminate at 11:00 AM on the day of the scheduled check-out.

6.2 If available, a $30 Early Check-in fee + $5.18 State of Hawaii Tax applies for early check in requests between 1:00 p.m. and 4:00 p.m.
6.3 If available, a $30 Late Check-out fee + $5.18 State of Hawaii Tax applies for late check-out requests between 11:00 a.m. and 2 p.m.

7. Special Events

​

7.1 Events are by inquiry only and must be authorized prior to making the reservation.

7.2 Bachelor/bachelorette parties and loud gatherings are not allowed. Unauthorized events will result in additional fees and eviction.

8. Cleaning & Trash

​

8.1 Daily housekeeping services are not included.

8.2 Guests are responsible for keeping the property clean.

8.3 Trash should be taken out daily to prevent pest issues.

8.4 Please note that this is a tropical environment and we request that you take out your trash daily. The cleaning crew charges $25 + State of Hawaii Tax for cleaning out any trash left in the condo at check-out....it’s a problem with pests and we insist the condo stays clean and free of excess trash that attracts pests. Thank you for your cooperation.

9. Smoking & Noise

​

9.1 Smoking or vaping is prohibited inside the accommodation or anywhere on the premises. Smoking must be done in designated areas.

9.2 Guests must adhere to noise restrictions between 10:00 PM and 7:00 AM.

10. Limitation of Liability

​

We are not liable for any loss, damage, or injury arising from your use of our Service, including accommodation, payments, cancellations, or property conditions.

11. Unavailability of Accommodation and Situations Affecting Your Stay

​

11.1 If accommodation becomes unavailable, we will notify you and provide options, including a refund, relocation, or future credit.

​

12. Governing Law

​

These Terms and your use of our Service are governed by the laws of the State of Hawaii, USA.

*****PLEASE NOTE:  17.962% (MANDATORY STATE OF HAWAII TAXES MUST BE COLLECTED FOR ACCOMMODATION, CLEANING FEES, EARLY OR LATE CHECK IN, DAMAGE CLAIMS, AND ANY INCIDENTALS OR CANCELLATION INCOME!!! SEE DETAILED INFORMATION BELOW.

 

17.962% Hawaiian Tax = Transient Accommodation Tax (10.25%) + General Excise Tax (4.712%) + Hawaii County Transient Accommodation Tax (3%), are automatically calculated and collected by Sanctuary Spaces booking service if you made your reservation after 01/01/2020. I am a licensed Short Term Rental host, and as a licensed host in the State of Hawaii, I am REQUIRED to collect taxes on any and all income generated to include income generated from early or late check in, cleaning, damage claims, incidentals and cancellations. I will provide a detail of taxes due based on your reservation, incidental created or income generated from a reservation cancellation for your payment approval which MUST be paid in full in order to confirm your reservation, no exceptions!
